Laws and Liability Issues
Based on this news report, it appears that the driver of the Tesla was driving at a high rate of speed when he crashed into the motorcycle at the intersection. California Vehicle Code Section 22350 (Basic Speed Law) states: “No person shall drive a vehicle upon a highway at a speed greater than is reasonable or prudent having due regard for weather, visibility, the traffic and on surface and width of, the highway, and in no event at a speed which endangers the safety of persons or property.” We also trust officials are looking into whether the driver was impaired, distracted, or otherwise negligent at the time of the collision.
In fatal car accident cases where negligence or wrongdoing is a factor, families of deceased victims might be able to file a wrongful death lawsuit seeking compensation for damages including medical expenses, funeral costs, lost future income, pain and suffering and loss of love and companionship. Victims’ families would be well advised to contact an experienced Los Angeles personal injury lawyer who will stay abreast of the official investigation and help ensure that their legal rights and best interests are protected.
