Bicycle Accident Statistics
One person was killed and 13 others were injured as a result of bicycle accidents in the city of Stanton, according to California Highway Patrol’s 2013 Statewide Integrated Traffic Records System (SWITRS). What Caused This Fatal Crash?
Based on this news report, the driver in this case was arrested by police on suspicion of vehicular manslaughter. But there are still many unanswered questions here. Was the driver under the influence of alcohol and/or drugs? Did he strike the bicyclist while driving distracted or while inattentive? Did the driver violate the rules of the road such as running a red light, failing to yield to the bicyclist or driving at an excessive rate of speed? Did the driver intrude into the shoulder or bike lane causing this fatal crash? These are just some of the questions law enforcement officials are likely asking during the course of this investigation.
Fault and Liability
In addition to facing criminal charges and penalties, negligent drivers can also be held financially responsible for the damages and losses they cause. Families of deceased accident victims in such cases can file what is known as a wrongful death lawsuit seeking compensation for damages such as medical expenses, funeral costs, lost future income, pain and suffering and loss of love and companionship. Families in such cases would also be well advised to contact an experienced Orange County bicycle accident lawyer who will stay abreast of the official investigation and help ensure that their legal rights and best interests are protected.
