Truck Driver Sought in Fatal Los Angeles Hit and Run
Authorities are looking for a large truck driver who fled the scene after a Los Angeles hit and run that killed a tow truck operator who was changing a disabled vehicle’s tire on the 5 Freeway near Castaic. According to a KTLA news report, California Highway Patrol officers responded to the scene on the southbound 5 Freeway about 3 miles north of Templin Highway the night of May 31.
Officials say 47-year-old Erwin Mendoza Geremillo was assisting a motorist when a big rig that had two trailers carrying rocks, hit him. Paramedics pronounced him dead at the scene. CHP has described the hit-and-run truck as possibly black and red or black and white with Arizona license plates. The investigation is ongoing.
We offer our deepest condolences to the family members of Erwin Mendoza Geremillo for their tragic and heartbreaking loss. Please keep them in your thoughts and prayers.
Leaving the Scene of a Los Angeles Hit and Run Crash
It is illegal under California law to leave the scene of an injury or fatal traffic accident. California Vehicle Code 20001 (a) states: “The driver of a vehicle involved in an accident resulting in injury to a person, other than himself or herself, or in the death of a person shall immediately stop the vehicle at the scene of the accident.” In addition, motorists are required to wait until authorities arrive, exchange pertinent information with all parties involved and most importantly, obtain help for the injured victim.
Justice for Victims and Their Families
In this particular case, since the hit-and-run driver was operating a commercial truck, both the driver and his or her employer can be held financially responsible for the victim’s wrongful death. Since Geremillo was on the job as a tow truck driver, his family may be able to receive workers’ compensation death benefits. In addition, they may also be able to sue the truck driver and the trucking company to obtain compensation for their tremendous loss.
Families of deceased hit-and-run victims would be well advised to contact an experienced Los Angeles hit and run lawyer who will stay abreast of the official investigation and ensure that their legal rights and best interests are protected.
