Hyundai Recalls Genesis Sedans for Defective Brakes
Hyundai is issuing an auto defect recall for about 27,500 of its Genesis sedans to fix defective brakes. According to a USA Today news report, 23 complaints have been received so far alleging incidents of increased brake pedal travel and reduced brake effectiveness in the model year 2009 Genesis vehicles, including one crash. This recall, which involves 2009 to 2012 model year vehicles, is a follow-up to one last March, which apparently did not catch all the vehicles affected by the problem.
The Danger of Brake Defects
Owners brought in only about 60 percent of the affected vehicles and Hyundai is hoping that the latest recall will help bring in the rest. The affected cars were manufactured from April 1, 2008, through March 16, 2012. In March, the Korean automaker, initiated a service campaign to replace the brake fluid in the affected vehicles.
When the recall begins, dealers will inspect the brake system and change the brake fluid with replacement fluid containing an anti-corrosive additive. The procedure will be conducted at no cost to owners.
Brake defects are serious safety issues because it hampers the ability of the vehicle to come to a stop when needed. In addition to causing collisions and injuring vehicle occupants, it can also cause injuries to others on the roadway such as bicyclists or pedestrians.
Liability Issues Involving Auto Defects
Anyone who has been injured as the result of a defective auto product can file an auto product liability claim against the carmaker. Such claims seek compensation for damages including medical expenses loss of wages, cost of hospitalization, pain and suffering and emotional distress. Families of deceased victims can file what is known as a wrongful death claim seeking compensation for damages as well.
It is important to remember that the vehicle is the most important piece of evidence in an auto defect case. Immediately after a crash, it is important the victims preserve the vehicle in its current condition unaltered so that an expert can carefully examine it defects, malfunctions and design flaws. An experienced auto product liability lawyer will be able to advise victims and their families regarding their legal rights and options.
